Atef Dridi, assistant director at the Ministry of State and Land Affairs, revealed that a project to revise the legislation relating to property belonging to foreigners and to the regularization of the situation of the occupants of these goods in Tunisia is being prepared.
Atef Dridi, stressed that the law relating to goods belonging to foreigners dates back to the 1990s, calling for its urgent revision. He said that several difficulties have been noted, hampering the regularization of the situation of the occupants of these goods.
In a declaration relayed this Wednesday by national radio, Dridi explained that the problems concern in particular the death of the majority of occupants and the existence of legal disputes between heirs. This has led to the need to amend the legal framework in order to allow the integration of beneficiaries in the regularization procedures.
He called for the reforms in harmony with the law promulgated in June 2024 on buildings threatening ruin, stressing that the revision of the legislation on the property of foreigners would make it possible to resolve many blockages and to facilitate approaches. He clarified that it is above all a social file, without lucrative objective for the State.
Regarding the fixing of the sale price of these goods, Dridi indicated that it is carried out by an expert under the areas of the State. However, he reported a certain disinterest on the part of the occupants to finalize the procedures and complete their files.
The official also mentioned the possibility of reviewing law n ° 78, which defines the conditions for the sale of real estate returning to the State under the Tuniso-French agreements, in order to facilitate the mechanisms.
Note that the Minister of State and Land Affairs had announced, during a plenary session in the Parliament at the start of the week, the regularization of around 4000 goods belonging to foreigners out of a total of 8000. He underlined the will of the commission responsible for the file to accelerate the treatment of the greatest possible files, in particular through a possible amendment of law n ° 78.
