Following the arrest of several engineers under the regional management of the equipment and governorate of Kasserine, in connection with the projects of the agricultural path of Boulahnech (delegation of Thala) and the Maison des Jeunes de Foussana, the Order of Tunisian Engineers (ILO) expressed strong concern.
In a press release, the ILO is surprised by the detention of engineers before the publication of the necessary technical expertise, even though the projects in question fall under the field of civil constructions and infrastructure, which require specific analyzes to identify any breaches and clearly determine responsibilities.
The organization reaffirms its commitment to the fight against corruption, but also insists on the need to respect the rights of the defendants, in particular their fundamental right to freedom in the absence of tangible evidence.
She also announces that she has mandated her legal advisor as well as her regional section in Kasserine to closely monitor the file and defend the engineers concerned, in the strict framework of the law.
The order recalls that technical or professional errors must, firstly, be subject to its disciplinary council, in accordance with articles 25 to 29 of the decree-law n ° 12 of 1982, ratified by law n ° 58 of the same year and modified in 1997.
Finally, the order calls for the adoption of a clear legal framework for the technical responsibility of engineers, with the obligation to use an expertise above all hearing. He also reiterates his request for revision of article 96 of the penal code as well as the legislation relating to preventive detention for administrative or professional faults, stressing that these practices slow down the initiative and the taking of responsibility in public projects.
Despite this case, the Order of Engineers affirms its confidence in Tunisian justice and in its fundamental role to guarantee an equitable working climate to all the professionals in the country, including engineers from all walks of life.
