The bill on employment contracts and subcontracting in detail

The president of the Finance and Budget Commission at the Assembly of People’s Representatives, Abdeljelil Hani, declared this Wednesday, April 2, 2025 that the bill on the organization of employment contracts and the prohibition of subcontracts abolishes fixed contracts. These will therefore be replaced by recruitments on permanent contracts “, adding that” the text takes into account seasonal professions by granting them specific contracts “.

During an intervention on Jawhara FM, Hani explained that “the misuse of fixed-term contracts and subcontracting, as well as the legal excesses that have arisen, have caused a feeling of threat and instability among workers”. He said that “the new bill has four chapters”.
He revealed that “article 1, which concerns employment contracts, stipulates that the only valid employment contract is indefinitely, with the possibility of including a trial period not exceeding six months, renewable only once for the same duration”.

He added that “the bill authorizes the conclusion of services for the provision of services or execution of work between companies, but only in exceptional cases”. He said that “article 6-4 prohibits the conclusion of fixed-term employment contracts, except in exceptional situations such as an unusual increase in the volume of activity, seasonal work or certain other specific activities”.

He also mentioned that “article 30 prohibits the conclusion of contracts for the provision of services or execution of work in violation of the provisions of article 3”.

The deputy stressed that “the second chapter of the bill, relating to the prohibition of subcontracting, abolishes the use of the subcontracting of labor, which previously allowed companies to recruit workers through service companies”. He revealed that “under this new law, any contract aimed at employing workers through a third -party company is considered illegal, exhibiting both the employer and that beneficiary of financial sanctions, or even prison terms”.

He said that “the law provides for a fine ranging from 1,000 to 10,000 dinars for legal entities (companies or institutions) in offense and a fine of 100 dinars for each public employee contravening the law”.

The chairman of the finance and budget committee explained that “the law provides for the automatic transformation of all fixed -term employment contracts into indefinite contracts, without the need to conclude a new contract”. Regarding permanent contracts already in force, “the integration of workers will be automatically will be made as soon as it enters into application of the law”. He also specified that, “according to these new provisions, all workers employed as part of subcontracting will be directly integrated into the company beneficiary of their services”.

Hani added that “workers whose fixed -term contracts were terminated after an employment relationship exceeding four years, between March 6, 2024 and the entry into force of the law, will be automatically integrated into the beneficiary company under the new text”. He said that “if the company refuses to regularize their situation, workers will have the right to take legal action and claim financial compensation”.
