Soon an express divorce from the notary bailiff?

A bill, currently under study at ARP, could allow Tunisian couples to divorce amicably before a notary bailiff, without going through the court.

Does Tunisia are preparing to revolutionize divorce procedures? The deputy Youssef Toumi, representative of the district of Zaouiet-Ksibet-Thrayet (governorate of Sousse), revealed to the microphone of Express FM, that the Commission of General Legislation of the Assembly of People’s Representatives (ARP) examines a bill that would make the date. This text aims to expand the powers of notaries bailiffs by allowing them in particular to pronounce a divorce by mutual consent, without judicial intervention.

“This measure aims to simplify and accelerate procedures, while lightening the burden weighing on the courts,” said the deputy. According to him, the bill already benefits from the support of 105 parliamentarians and is currently the subject of in -depth discussions within the Commission.

This project is part of a broader desire for reforming the legal framework supervising the profession of notary in Tunisia. It would be a question of modernizing its role, by adapting it to the current needs of citizens, in particular in matters of proximity justice and unclogging of the judicial system.

If this reform is adopted, it will introduce a paradigm shift in the management of family affairs. It remains to be seen whether the necessary guarantees will be set up to protect the rights of the parties, in particular those of women and children, in this new framework.
