ISIE case – Abir Moussi: The Court of Appeal sets the hearing for November 21

The Criminal Chamber of the Tunis Court of Appeal decided this Friday to postpone until November 21, 2025 the examination of the case between the president of the Free Destourian Party (PDL), Abir Moussi, and the Independent Authority for Elections (ISIE). This decision aims to allow the appointment of a lawyer responsible for his defense.

A conviction at first instance

Abir Moussi appeared this Friday before the Court of Appeal to challenge the first instance judgment sentencing her to two years in prison. This sentence stems from a complaint filed by the ISIE, following a media statement deemed defamatory of the electoral institution.

The Court therefore adjourned the session in order to guarantee the presence of defense counsel, an essential condition for the continuation of the procedure.

A file based on Decree-Law 54

The criminal chamber of the Tunis Court of First Instance sentenced Abir Moussi, on June 12, to a two-year prison sentence in the context of this case brought by the ISIE, following comments made by the opponent on the subject of the 2022 legislative elections.

The case dates back to a press conference organized on December 9, 2022, during which Abir Moussi publicly questioned the organization of the vote and the legitimacy of its results. His statements led the ISIE to file a complaint, believing that they undermined the integrity of the electoral process.

It is being prosecuted on the basis of article 24 of decree-law no. 54 relating to the fight against offenses linked to information and communication systems.
