Corruption: Towards a new law to protect whistleblowers in Tunisia

Faced with the resurgence of corruption and the absence of a dedicated body since the dissolution of the INLUCC, an amendment project of the 2017 law launchers is being examined at ARP. Objective: to guarantee better legal and institutional protection to those who dare to denounce abuse.

The parliamentary committee responsible for the organization of the administration, governance and the fight against corruption began examining a bill aimed at amending organic law n ° 10-2017 relating to the reporting of corruption facts and the protection of whistleblowers.

Submitted by fifteen deputies, this project is involved in a context of institutional emptiness, aggravated since the dissolution of the national body to combat corruption (INLUCC) in 2021. It aims to restore a functional legal framework to promote the reporting of abuse and guarantee the whistleblowers effective protection.

According to the explanatory document published on the ARP website, the absence of a specialized authority to receive and treat alerts has discouraged many citizens to denounce illicit practices, aggravating the spread of corruption at different levels of the State.

The authors of the amendment underline that several whistleblowers have been victims of reprisals ranging from dismissal to arbitrary transfer, or even legal proceedings. They therefore call for a legal framework which would guarantee not only the professional security of these people, but also their reinstatement and the payment of their rights.

The project, composed of 42 articles, intends to define precisely the reporting procedures, the protective mechanisms as well as the periods of regularization of professional situations. He also proposes, in his article 2, the creation of a new specialized structure, in replacement of the INLUCC, responsible for centralizing the reports and coordinating protective measures.

This bill could, if adopted, mark an important turning point in the national strategy to combat corruption in Tunisia. However, he will have to take several stages before his final adoption in plenary session.
