ARP is preparing to vote for the reform of the labor code

The Assembly of People’s Representatives (ARP) is preparing to take a decisive step in the reform of the Labor Code. A final consultation session between the parliamentary committee concerned and the Ministry of Social Affairs is scheduled for Wednesday, May 14.

The final adoption of the amendment project in plenary is expected the following week. This was announced by Youssef Tarchoun, rapporteur of the Internal Regulations commission at the ARP, this Monday, May 12 during his intervention on the Mosaique FM radio.

According to him, the text has been the subject of a long audition process: more than ten meetings were organized with experts and labor law specialists, making it possible to identify a consensus on all articles.

“We have corrected several gaps to make the law more complete and more protective of workers’ rights,” he said. Among the most sensitive points: the use of subcontracting and the provision of services, often used to bypass the obligations linked to the wages.

The project introduces a clear and legally supervised definition of the provision of services, in order to prevent cases of harassment and exploitation observed in certain companies.

Another major project: fixed -term contracts (CDD). The text provides for a revision of the rules framing the trial period, the duration of which will now vary according to the professional categories. The arrangements related to absences and seasonal work have also been revised to better protect precarious workers.

The adoption of this new legal framework is part of a displayed desire to modernize working relationships in Tunisia, while guaranteeing a balance between flexibility for employers and employee protection.
