The Moroccan Ministry of Justice has unveiled a bill aimed at granting nationality to foreign nationals marrying Moroccans.
Having a Moroccan will give the right to nationality, this is what the Cherifian kingdom envisages. The Minister of Moroccan justice, Abdellatif Ouahbi, stressed that this measure represents a significant step towards gender equality in matters of human rights and a concretization of the rule of law and the law.
Morocco strives to modernize its legal framework to comply with its international obligations and international agreements, thus aligning the global standards in the acquisition of nationality, he added.
The Minister also stressed that his ministry is attentive to political, social and cultural developments linked to human rights, as well as to the values of modern society and to the constitutional principles which promote equality and fight against discrimination.
In this perspective, a bill n ° 019.13 was presented to modify article 10 of the Moroccan nationality code, allowing foreign spouses to acquire Moroccan nationality through marriage with a Moroccan citizen.
This article, modified by law n ° 62-06 promulgated by DAHIR n ° 1-07-80 of March 23, 2007, stipulates that only “the foreign woman who married a Moroccan can, after a habitual and regular residence in Morocco of the household for at least five years, to subscribe, during the conjugal relationship, a declaration addressed to the Minister of Justice, in order to acquire Moroccan nationality”.
