The United Nations General Assembly adopted, this Friday, October 27, 2023, a resolution in favor of a Truce and “the protection of civilians”.

The draft resolution, presented by Jordan, received 120 votes, 14 against including Israel and the United States and 45 abstentions including Tunisia.

The resolution of the United Nations General Assembly calls for the immediate implementation of a humanitarian break between Israel and Hamas and requires the entry of aid into the Gaza Strip and the protection of civilians.

The vote has taken place after the Security Council failed to act four times in the past two weeks.

The text of the resolution

“Writing strongly concerned about the last climbing of violence since the attack of October 7, 2023 and by the serious degradation of the situation in the region, in particular in the Gaza Strip and in the rest of the occupied Palestinian territory, including Jerusalem-Est, and in Israel,

Condemning all acts of violence directed against Palestinian and Israeli civilians, in particular all acts of terrorism and indiscriminate attacks, as well as acts of provocation, incentives and destruction, recalling that it is important to respect the principles of distinction, necessity, proportionality and precaution in the conduct of hostilities,

Stressing that civilians must be protected, in accordance with international humanitarian law and international human rights law, and deploring heavy civil losses and generalized destruction in this regard, insisting on the need to ask those responsible for those responsible and stressing in this regard the importance of ensuring that independent and transparent surveys are engaged, in accordance with international standards,

Convening itself seriously concerned about the catastrophic humanitarian situation which reigns in the Gaza Strip and by its vast consequences on the civilian population, largely made up of children, and stressing the importance of total, immediate, safe, sustainable and without hindrance humanitarian access,

Understanding without reserve the action carried out by the Secretary General and his calls for immediate access and without restriction of humanitarian aid, to meet the most basic needs of the civilian Palestinian population in the Gaza Strip, emphasizing the message of the Secretary General according to which food, water, drugs and fuel must be assured in a sustainable and large scale, and expressing its thanks to Egypt fundamental role in this regard,

Expressing his firm support for the action carried out on regional and international levels to achieve an immediate cessation of hostilities, ensure the protection of civilians and provide humanitarian aid, recalling that one will be able to achieve a lasting settlement of the Israeli-Palestinian conflict only by peaceful means, based on the relevant resolutions of the UN bodies and in accordance with international law,

1. Request an immediate, sustainable and sustained humanitarian Truce, leading to the cessation of hostilities;

2. Perses all parties to fully and fully fulfill the obligations imposed on them by international law, including international humanitarian law and international human rights law, in particular with regard to the protection of civilians and civilian goods, as well as the protection of humanitarian staff, out of combat, and humanitarian facilities and goods, and to allow and facilitate humanitarian access for the delivery of supplies and civilians who are in need in the Gaza Strip;

3. Urban the supply to civilians, throughout the Gaza Strip, essential goods and services, in particular water, food, medical supplies, fuel and electricity, be ensured immediate, continuous, without hindrance and sufficient quantities, stressing that international humanitarian law requires ensuring that civilians are not deprived of the goods essential to their survival;

4. Request that the United Nations Rescue and Work Office for Palestine refugees in the Middle East and other humanitarian organizations in the United Nations and their execution partners, the International Cross Committee-Red and all other humanitarian organizations benefit from immediate, total, sustainable, safe and unhindered access, in accordance with humanitarian principles, with a view to the delivery of urgent assistance of the Gaza Strip, encourages the establishment of humanitarian corridors and other initiatives aimed at facilitating the delivery of humanitarian aid to civilians, and welcomes the action carried out in this regard;

5. Also request the cancellation of the order given by Israel, occupying power, Palestinian civilians and the United Nations staff, as well as to the humanitarian and medical workers, to evacuate all the areas of the Gaza Strip located north of Wadi Gaza and to reinstall themselves in the south of the Gaza Strip, recalls and reaffirms that civilians are protected with regard to humanitarian humanitarian law and must receive humanitarian aid Wherever they are, and recalls that it is important to take appropriate measures to guarantee the safety and good -being of civilians, in particular children, and their protection, and allow their free movement;

6. Firmly reject any attempt at forced transfer from the Palestinian civilian population;

7. Request the immediate and unconditional release of all civilians who are illegally retained in captivity, requires that their security and well-being be assured and that they be treated with humanity, in accordance with international law;

8. Also requests respect and protection, in accordance with international humanitarian law, of all civil and humanitarian facilities, including hospitals and other medical facilities, as well as their means of transport and equipment, schools, places of worship and United Nations facilities, as well as humanitarian and medical staff and journalists, media professionals and associated staff, in the armed conflict in the region;

9. Highlights the particularly serious effects that armed conflict has on women and children, refugees and displaced in particular, as well as on other civilians who may have particular vulnerabilities, such as people with disabilities and the elderly;

10. highlights the importance of urgently establishing a mechanism to ensure the protection of the Palestinian civilian population, in accordance with international humanitarian law and the relevant resolutions of the UN organs;

11. insists on the importance of establishing a humanitarian notification mechanism to protect the United Nations facilities and all humanitarian facilities and guarantee the unhindered circulation of convoys of aid;

12. emphasizes that it is important to avoid a new destabilization and the escalation of violence in the region and, in this regard, asks all the parties to show the greatest restraint and to all the actors who have an influence on them to work to achieve this objective;

13. Reaffirms that one will only be able to achieve a lasting settlement of the Israeli-Palestinian conflict only by peaceful means, based on the relevant resolutions of the UN bodies, in compliance with international law and on the basis of the two states solution;

14. Decides to postpone the tenth extraordinary emergency session on a provisional basis and to authorize the president of the Assembly to his most recent session to pronounce the recovery at the request of Member States. »»
