With the imminent entry into force of the new Retailleau circular, some foreigners in an irregular situation, in particular the parents of schooling children, will no longer be able to claim a regularization of their situation in France.
In the coming weeks, the new Minister of the Interior, Bruno Retailleau, plans to send two new circulars to the prefects. One of them will replace the so-called Valls circular, in place since 2012, which has so far allowed many undocumented migrants to submit requests for residence permits and to be regularized.
The Valls circular, which made it possible to regularize around 30,000 foreigners per year, establishes the criteria for examining the requests for admission to the stay filed by nationals in an irregular situation.
Among the beneficiaries were parents of schooling children, spouses of foreigners in regular situations, foreigners who arrived minor and adult, as well as people who have rendered exceptional services to society.
The abolition of the Valls circular means a hardening of the regularization conditions. Retailleau has announced its intention to drastically reduce the number of regularizations, indicating that they will now be “dropping out”.
This new approach will considerably limit the possibilities for undocumented migrants to regularize their situation, including parents of children educated for more than three years.
